These terms and conditions (the “Terms”) apply when you place an order on www.tigerofsweden.com (the “Website”).

By placing your order on the Website, you accept these Terms. Therefore, please read these Terms carefully before placing your order.

When we say “we”, “us” or “Tiger of Sweden”, we mean Tiger of Sweden Denmark AS (company reg. no 38 75 30 29).

To place an order on the Website, you must be at least 18 years of age and not be under guardianship. You must also possess a valid credit card accepted by us, have a valid email address and a delivery address in one of the countries we deliver to (see Section “8. Deliveries” below).

We only accept orders from private consumers, and you are not allowed to place orders for or on behalf of a business or for commercial activities.

We may update the Terms from time to time (for example to reflect changes in technology, our business model, our systems’ capabilities or relevant laws and regulations), why we recommend you to check this page regularly to take notice of any changes made. However, please note that the Terms that you accept at the time of your purchase will always apply for that particular purchase. Changes in the Terms will take effect from the time that you accept the Terms when making a new purchase. 

By placing an order on the Website, you are making an offer to purchase the products you have selected on these Terms. The moment you click ”Place Order” and the receipt is displayed on your screen, you are making a binding offer to us to purchase the product(s) in the shopping bag. Offers can only be made through our website.

A placed order does not constitute a binding contract until the order has been approved by us. Your offer may or may not be accepted at our discretion. Please note that the displayed receipt is an automated acknowledgement that means that your offer has been received; it does not mean that the offer has been accepted by us. We reserve the right to decline your offer after you have received the automatic receipt. If your offer is accepted, we will send you an e-mail confirming that we have accepted your order (order confirmation). The contract between you and us will be effective from the time that the order confirmation is sent.

We may decline an offer or cancel a purchase in any of the following situations, without being liable for any damages or costs. We will notify you by email in advance of any such action, to try and resolve the issue and will return any applicable payments made to us without deduction:

  • Your payment information is incorrect or not verifiable, or you are not approved in the credit evaluation;
  • Your order may have been placed for fraudulent purposes, or in connection with a criminal offence or other unlawful activity;
  • There was an unintentional error on the Website, e.g. a payment error etc.;
  • We have reason to believe you are a minor under the age of 18;
  • We could not deliver to the address provided by you.

We may also decline an offer if the ordered items are out of stock (although we of course endeavor to have all offered items in stock) or if there was an unintentional pricing error of the product. Also in these cases, we will notify you by email in advance of any such action, to try and resolve the issue and will return any applicable payments made to us without deduction.

If you made an error when placing your order, please contact us and we will be happy to assist you. However, please always make sure to review your offer before placing it. Before submitting, you have the possibility to edit any information you have entered, such as the delivery or billing address or credit card information, or change or delete items in your shopping bag.

We store all contracts made, including your offer and the order confirmation, and we recommend that you file these too, as subsequently the documents will not be accessible. However, please see section "8.4 Track your order and view history" below.

Please note that we cannot accept any other payment method than those specified above. If you try to pay by any other method, we will not be liable for your loss of payment or any other damage caused by your action.


3.2 CREDIT CARD VERIFICATION NUMBER

To maintain your own security and prevent fraud, you will be asked to enter your Card Verification Number (CVV) when paying with credit card. You can find the 3 digit number on the back of your credit card. It generally appears to the right of your credit card number.


3.3 PAYMENT PROCESSING

If you place your order with a credit card, the payment will be deducted from your bank account when your order and data have been verified and your ordered products leave our stock for delivery.

If you place your order using PayPal, Mobile Pay, real-time banking, iDeal or a debit card, the payment will be deducted from your account when we confirm your order.

If you place your order with Klarna, the payment will be deducted from your bank account once you have paid the invoice.

Please note that your billing address must be entered exactly as it appears on your bank statement.


3.4 FRAUD SCREENING

In order to protect our customers and maintain the security of shopping online, we may run verification checks on the data you submit when you place an offer. These checks may include address and payment verification and screening of your offer to prevent fraud.

All prices on products, delivery charges and other services include the statutory value added tax (VAT).

The delivery charge is added per order. In the checkout view, the total cost for your purchase including the delivery charge will be displayed. The delivery charge vary from country to country and also depends on the chosen delivery option and the ordered items. All available delivery options, as well as the associated delivery charges, are presented in the checkout view.

If you are residing outside the EU and eligible for a VAT refund on your purchase, we will refund the VAT on your purchase, provided that you submit to us (i) documentation that your place of residence is outside EU, (ii) a copy of your invoice complete with such stamps and confirmations from customs authorities in the exporting country as are required under the rules applicable at the time of your request for the refund, and (iii) any other documentation that may be required by the authorities in the country where you have made your purchase. The documentation should be submitted to Customer Service in the country where you have made your purchase. We may decline the VAT refund, if we assess that the documents you have provided do not meet applicable requirements.

The prices displayed on the Website are those that apply at the time of purchase. The prices may be subject to change without notice, but changes will not affect orders which we have accepted. We endeavor to avoid information errors, but please note that pricing errors, spelling errors and other errors or mistakes can occur from time to time. We will verify prices as part of our confirmation procedures. If the correct price is less than our stated price, the lesser amount will be charged to you. If the correct price is higher than the price stated on our Website, we will attempt to contact you. If we are unable to contact you, we will reject your offer and notify you by e-mail.

All displayed prices are quoted in the currency that refers to your country. Your delivery address will decide which currency you will be charged in. Please note that changing the country of delivery may have an influence on the price and the delivery costs. We accept payment in the currencies listed below:

We utilise Security Socket Layer (SSL) technology, one of the most secure systems for ordering online that allows encryption of your information, such as your name and address, and critical personal information, such as credit card information. Your information will be encrypted from the moment you enter it, and your personal information will not be saved on a public server. That means that information passed between you and our Website cannot be read in the event someone else intercepts it. The SSL technology provides an authentication that assures your browser that your data is being sent to the correct secure computer server, an encryption that encodes all data, so only the secure server is able to read it, and a data integrity that checks that the transferred data has not been altered.

8.2 DELIVERY TERMS

Currently, we offer delivery with the following shipping carriers:

  • Postnord
  • DHL
  • UPS

The delivery carriers available depends on the country that you are shipping to and which services are available in that country. The delivery options can be seen in the cart once you are ready to check out your order. The different prices per carrier can also be shown there, since these might differ depending on the location/carrier. 

Please note that all deliveries will be to your home address, and not to a pick-up point. Please make use of the tracking information received from your order, so you are able to see when your order will be delivered. It is always recommended to make sure that someone is at home to collect your parcel.

As a Tiger of Sweden Society member, we offer complimentary standard shipping on purchases for customers in Denmark and Finland. For all other markets we offer complimentary standard shipping on purchases over a minimum order value when logged in to your account. Please refer to the shopping bag to view the complimentary shipping threshold for your region. Read more here.

Orders will be delivered Monday through Friday. Please note that we do not ship to P.O. boxes. All deliveries must be signed for at receipt, except if another option is provided by the courier. If the order is delivered to a pick-up point, the courier will keep the parcel for 10 calendar days before returning it to us as undelivered.


8.3 DELIVERY TIMES

Your ordered products will be delivered from Monday through Friday, and the exact delivery time depends on the country of delivery. An order that has been submitted on a Danish public holiday will be processed the next working day following the public holiday.


8.4 TRACK YOUR ORDER AND VIEW HISTORY

When you have an account at the Website, you can track your orders by visiting "My Account" and clicking "My orders". There you can view your past orders and the status of your current order. If you don’t have an account, please contact us and we will do our best to inform you about your order status.


8.5 PRODUCT INSPECTION

Please note that you bear the risk for the products you have ordered when the delivery is completed. If the packaging appears to be damaged, please do not accept the shipment. Without prejudice to your statutory rights and remedies, you have the responsibility of inspecting your products for any faults and, in the event, giving us notice of any complaints. Read more under section “Defects and Incorrect Terms” below. 

9.1 THE RIGHT OF WITHDRAWAL

According to applicable consumer protection legislation, you may withdraw your whole order or part thereof for any reason at all within 14 days from the day you receive your order. In case of split deliveries, the withdrawal period expires 14 days after the day you receive the last product in the order.


9.2 HOW DO YOU EXERCISE YOUR RIGHT OF WITHDRAWAL?

You can exercise your right of withdrawal in several ways.

1)     Within the withdrawal period, you can inform us of your wish to make a return. The notice can be given by filling in and submitting the withdrawal form available here (but it is not required), or by contacting us by letter or email. You must return the product to us within a reasonable time from sending the notice, in any case no later than 14 days from the day on which we were informed about your decision to withdraw from the purchase. Please see the Return Guide that came with your order for more information.


2)     Within the withdrawal period, you can also exercise your right of withdrawal by handing over the product to the postal services or another operator who has taken on the task of forwarding the product to us, even if you have not given prior notice to us.


3)     You may also exercise your right of withdrawal by abstaining from receiving the product or by abstaining from collecting it at the post-office etc.

Multiple purchases leading to returns cause unnecessary emissions. As a company, we are looking into ways in which we can improve our sustainability efforts. We therefore ask you to please contact our Customer Service if you have any questions regarding your garments – they are happy to answer any of your queries ahead of your purchase. If you have any uncertainties about what size or style to order – we’re here to help. Our Customer Service will gladly guide you through our assortment and size charts. Together we can help save the environment from unnecessary emissions.


9.3 EFFECTS OF WITHDRAWAL

If you choose to make a return, we will refund the total purchase amount as well as the cost of delivery (but deduct a return fee, see further below). However, please note that we will not refund any supplementary costs resulting from your choice of a delivery option other than the least expensive type of standard delivery offered by us.

If you choose to keep certain items and only return parts of your order, the delivery cost will not be refunded.

Please note that we will charge a return fee to cover the cost of returning the goods. The return fee corresponds to a standard shipping cost, and will be deducted from your total refund amount. The refund will be made using the same means of payment that you used for the original transaction, unless you have expressly agreed otherwise.

We aim to process a refund within 3 days of receiving the returned package, or of receiving a receipt that you have returned the package. We will notify you via e-mail that we have received and processed your case. From the time you receive our email, it takes another 5-10 business days for the refund to reach your account. How long it takes depends on which bank or card issuer you have, which is beyond our control.

The refund will be made without undue delay, but no later than 14 days from the date we were informed of your decision to withdraw from the purchase agreement.

Please note that returned items must be in substantially the same condition as when sold. You are responsible for any deterioration in the value of the items that occurred as a result of careless handling, or handling that is not necessary to determine the nature, characteristics or function of the product.


9.4 EXCHANGES

Items can be exchanged within 14 days of delivery. Within the EU, we offer you one complimentary exchange per order.

10.1 DEFECTS

When we ship your products, we do our best to make sure that the products are top quality and in perfect condition. Your national legal guarantee of conformity for goods applies to your purchase.

In case of defective products or inconformity with your order, you will have the choice of (i) returning the defective product against a full refund of the purchase price and delivery cost or (ii) keeping the product and asking for a price reduction.

Please note that products that are damaged as a result of wear and tear, or because of your conduct, are not considered defective.

The claim shall be made when you discover the defect. Any notice given within a period of two months after you discovered the defect is deemed a timely notice, but in certain cases a longer period may apply under applicable law. Please contact us and we will arrange for the product to be collected by our courier. If you wish to place another order, we will be happy to assist you.

For customers subject to French law, the following applies:

  • There is a warranty against any hidden defects of the goods sold, which applies for two years following the discovery of the defect.
  • There is a warranty of conformity of the Consumer Code, which applies for two years from the delivery of the product.


10.2 INCORRECT ITEMS

Occasionally, the wrong item may get sent out. If this has happened to you, we sincerely apologize. Please contact Customer Service who will be able to re-order the correct item for you and arrange for the incorrect product to be collected by our courier.

We make a great effort to ensure that the information on the Website is accurate, complete, and up to date. Nevertheless, information may temporarily contain errors, be incomplete or out of date. We are not bound by any incorrect, incomplete or outdated information if you realized or should have realized that the information was incorrect, incomplete or out of date. 

To the extent permitted by the applicable law, we shall not be liable for any damage caused by incorrect, incomplete or outdated information on our Website, unless such damage is the result of our gross negligence or willful misconduct. 

We are only liable for damages when such damages result from our breach of contractual obligations towards you, or in the event our liability follows from applicable statutory law. If any activities on the Website have caused you damage, we shall only be liable for damage to the Tiger of Sweden products, reasonable and verifiable costs incurred by you to find out the cause and amount of damages as a result of our breach of contract or liability under applicable statutory law; and reasonable and verifiable cost to prevent and diminish such damages. We shall we be liable for your improper use of any of our products. 

The Website may include links to other websites maintained by third parties. We shall not be liable for any use of or any content of internet sites that this Website provides links to. Neither shall we be liable for use or content of any websites from which are linked to this Website.
